This Policy explains what information we collect, how we use it, and the choices available — both to our customers (investors and professionals who use the Service) and to property owners whose information appears in our data.
1. Scope
firstoffmarket is a real-estate investor data platform. We aggregate public records and licensed third-party data about real property and its owners, and we provide access to that data to business customers. This Policy covers both our customer relationships and the personal information we process about property owners.
2. Information we collect
From customers (account holders): - Account info: name, email, business affiliation, the signup attestation, and acceptance timestamp/version. - Billing info: processed by Stripe; we do not store full card numbers. - Usage data: searches, exports, skip-trace requests, log/IP/device data.
About property owners (the data we aggregate and provide): - From public records (county recorder, assessor, treasurer): owner name, mailing/property address, parcel and ownership details, recorded foreclosure-related filings, tax-delinquency status. - From licensed third-party providers (e.g., BatchData): contact information (phone, email), valuation/AVM estimates, vacancy and distress indicators, and DNC / TCPA-litigator flags.
3. Sources
County recorder / assessor / treasurer public records; licensed data vendors; and information our customers provide directly (account and billing).
4. How we use information
- To provide, operate, secure, and improve the Service.
- To process subscriptions and payments.
- To make aggregated public-record and licensed data available to customers, which is the core function of the Service.
- To maintain the skip-trace audit log (retained 12+ months) for compliance and dispute resolution.
- To comply with law and enforce our Terms.
We do not use property-owner contact data to contact property owners ourselves, and we do not send marketing or any communications to property owners.
5. How information is disclosed
- To customers: the aggregated property and owner data is disclosed to our business customers — this is the product. Under some state privacy laws this may be considered a "sale" or "sharing" of personal information; see §8.
- To service providers (processors): Stripe (payments), our data vendors, hosting/infrastructure, email delivery, and analytics — bound to use the data only to provide services to us.
- For legal reasons: to comply with law, respond to lawful requests, or protect rights and safety.
- Business transfers: in connection with a merger, acquisition, or sale of assets.
We do not disclose customer account information to other customers.
6. Cookies and analytics
We use essential cookies and privacy-respecting analytics (e.g., Google Analytics 4 / Search Console) to understand and improve the Service. You can control cookies through your browser. (Counsel/MKT-021 to confirm cookie-banner requirements for applicable jurisdictions.)
7. Data retention
We keep customer account data for the life of the account and as needed for legal/tax purposes. The skip-trace audit log is retained at least 12 months and may persist after account closure. Public-record-derived data is refreshed and may be removed per §9.
8. Your privacy rights (state laws)
Depending on your state of residence (e.g., California — CCPA/CPRA, and similar laws in other states), you may have the right to: know what personal information we have, request deletion, correct it, and opt out of the "sale" or "sharing" of your personal information.
Do Not Sell or Share My Personal Information / Deletion: submit a request to privacy@firstoffmarket.com or via the contact form linked in our site footer. We will verify and respond within the timeframe required by law (generally 30–45 days).
Known open item (see README): Because we provide access to personal information for commercial purposes, we may qualify as a data broker under California (CA Delete Act / DROP) and other state laws, which can require annual registration and honoring deletion via centralized mechanisms. This is flagged for counsel and must be resolved before scaled operation in those states.
9. Property-owner data requests
If you are a property owner and want your information removed from our public preview pages, email privacy@firstoffmarket.com or use the footer contact form. We honor verified requests within 30 days. Note that the underlying records remain public at their source (the county), and removal from our preview pages does not remove them from government records or from data already lawfully exported by customers before removal.
10. Security
We use reasonable administrative, technical, and physical safeguards (access controls, encryption in transit, least-privilege secrets handling). No system is perfectly secure; we cannot guarantee absolute security.
11. Children
The Service is for business use and is not directed to anyone under 18. We do not knowingly collect information from children.
12. Changes to this Policy
We may update this Policy; material changes will be notified by email or in-product. The "Effective date" reflects the latest version.
